Texas SB 2024: Statewide Ban on Hemp-Derived Vapes Takes Effect September 2025

Texas‘s new vape law, SB 2024, signed by the governor in June 2025 and effective September 1, 2025, bans certain vape products, including disposables from "foreign adversary" countries like China, products with child-appealing designs, and those containing non-nicotine intoxicating substances like cannabinoids. The law targets products with youth-oriented marketing, specific design features, and those containing substances like THC, while allowing for U.S.-filled e-liquids and refillable devices. 

What SB 2024 Bans (Effective September 1, 2025)
"Foreign Adversary" Disposables:
Prefilled disposable vapes manufactured or marketed as being from China or other "foreign adversary" countries are banned. 
Child-Appealing Products:
Vapes that feature child-appealing design elements, such as characters, food-like imagery, or youth-targeting symbols, are prohibited. 
Products with Non-Nicotine Intoxicants:
The law bans vape products containing intoxicating substances other than nicotine, such as hemp-derived cannabinoids, kratom, alcohol, or derivatives of these substances. 
Disguised Products:
Vapes disguised as other objects like USB drives, pens, or cosmetics are also prohibited. 

What is Still Legal 
Refillable Devices:
Refillable vape systems and e-cigarettes are generally allowed, provided the e-liquid is filled in the U.S. and the product does not violate other provisions.
U.S.-Filled Disposables:
Prefilled disposable vapes filled with U.S.-made e-liquid, even if made in China, are generally permitted.
FDA-Authorized Products:
Products authorized by the FDA and filled domestically are not affected by the ban on China-made disposables.

Penalties for Violations 
Violating the terms of SB 2024 is now a Class A misdemeanor, carrying potential penalties of up to one year in jail and a $4,000 fine per offense.
